PUPPY CONTRACT

The following is an example of the puppy contract and will need to be signed on pick up date.

When you purchase a puppy from me you are agreeing to this Puppy Contract
whether you sign it or not.
This contract between the seller, Fun size Aussies, and the buyer ________________________.
Said puppy is sold to buyer on ________________, at the total price of $___________. A non-
refundable deposit of $200 on said puppy is due up front in order to hold the puppy for pick up.
Please Note, any deposit to hold a puppy is non-refundable and non-transferable for any
reason.

A. To the best of my knowledge, said puppy is currently healthy and sound condition at the
time of sale. Buyer has 72 hours, from the time of pick up, to have a licensed
veterinarian perform a health check on the said puppy. Buyer must vaccinate the said
puppy on week 16 of age, parvo and distemper vaccines must be given at two-four week
intervals following first vaccines given by breeder. If buyer fails to have vet check done
within 72 hours or fails to continue vaccines as stated above, the parties agree that any
guarantee will be considered null and void. Keep shot records from your vet.
B. All puppies are sold at PET QUALITY only, this does not mean they are, or are not
show/breed quality.
C. Health guarantee does not cover any parasite, internal or external as this is a treatable
condition.
D. As the seller, I understand that the typical puppy buyer is not necessarily as experienced
with raising puppies as I am. If there is any concern at anytime with your puppy, please
call right away for tips and advice. Sometimes I can save un-needed trips to the vet. I am
always happy to share knowledge and advise on my puppies/dogs.
E. Seller is in no way responsible for any vet bills made after puppy leaves the care of Fun
Size Aussie’s. If a problem should arise with said puppy, buyer should contact seller
immediately. Each case is dealt with individually as every situation is different. Seller will
not refund money unless a licensed vet has verified a life threatening genetic disease or
defect. Any and all vet bills are the responsibility of the buyer.
F. No Refunds will be given except by Veterinarian rejection for life threatening disorder at
the time of the first health check within 72 hours. No refund will exceed the purchase
price of the puppy nor includes the cost for fees, goods, or services.  At the time of pick

up the said puppy is healthy with no sign of illness.
G. This contract is under the jurisdiction of the state of Tennessee. In the event of any
dispute, the parties mutually agree tat the dispute will be settled under the jurisdiction
of Rutherford county, Tennessee. All parties mutually agree that all lawyer fees shall be
paid by the buyer.
H. If court of law finds any parts of this agreement unenforceable, all remaining provisions
not deemed unenforceable will be enforced to the full extent of the law.
I. This agreement sets forth the entire agreement between both parties. This agreement
may not be changed, altered or amended except in a writing signed by both parties.

J. If no breeding agreement was made before the date of signing of this contract then proof

of spay/neuter must be received by the (buyer) and sent to Fun Size Aussies within fourteen

(14) days after the surgery.  The buyer agree to have this dog spayed/neutered by no later

than eight months of age unless agreed upon prior to signing.  The buyer understands that

this spay/neuter agreement is an agreement that this puppy ill not produce a litter of

puppies either as purposely bred or by accidental breeding.  Failure to comply with this agreement

by the date above, unless otherwise agreed to in writing, will be a breach of contract,

puppy and the litter, if a litter was born, will be transported to Fun Size Aussies at the

buyers expense and will not be entitled to a refund.
I The undersigned buyer have read, understand and agree with al of the terms and
conditions set forth in the sales contract.
